The service
Local Gap is provided by Local Gap. It displays local businesses from Google Maps Platform on a map, indicates whether Google Maps currently lists a website for each business, and lets you keep private notes, a lead pipeline and route plans. By creating an account you agree to these terms and to our Privacy Policy.
Google Maps features and content
Local Gap includes Google Maps features and content. Your use of those features and content is subject to the then-current Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. Our own use of Google Maps Platform is governed by the Google Maps Platform Terms of Service. If you breach the Google terms we may suspend or close your account.
Accuracy of business information
Business names, addresses, phone numbers, ratings, review counts and website links are supplied by Google Maps and may be incomplete, out of date or wrong. "No website listed by Google Maps" means exactly that; it is not a statement that a business has no website. Verify details before relying on them. We do not guarantee that any area has been searched completely.
Plans, subscriptions and search allowances
Local Gap is currently in private testing. No paid subscriptions or purchasable search credits are offered. Each account has fair-use limits on searches, detail look-ups and route calculations per minute, day and month, which we may change without notice. Nothing in this section implies that any third party has approved a paid service.
Acceptable use
You must not:
- access the service by automated means, scripts, bots or scrapers, or share access credentials;
- scrape, copy, bulk-download, export, store or redistribute business information obtained through Local Gap, other than the place reference and your own notes, or use it to build a database, directory, mailing list or competing product;
- resell, sublicense or otherwise commercialise information supplied by our data providers;
- attempt to bypass usage limits, security controls or feature restrictions;
- use the service in breach of the New Zealand Unsolicited Electronic Messages Act 2007, the Privacy Act 2020, the Fair Trading Act 1986 or any other law.
Responsible outreach
You are solely responsible for how you contact businesses you find. Commercial electronic messages must have the recipient's consent, identify you accurately and include a working unsubscribe facility. Respect requests not to be contacted and keep accurate records of consent.
Your content
You own the notes, labels and route names you create. You grant us the right to store and display them to you in order to provide the service. Do not store sensitive personal information about other people in your notes.
Suspension and termination
We may suspend or terminate accounts that breach these terms, abuse the service or our providers, or create legal risk. You may delete your account at any time from Settings; deletion is immediate and permanent.
Availability and changes
We may change, limit or withdraw features, including where required by our data providers. We do not promise uninterrupted availability.
Liability
To the fullest extent permitted by law, the service is provided "as is" and we exclude all warranties. We are not liable for indirect or consequential loss, loss of profit or loss of business arising from your use of the service or reliance on business information. Where liability cannot be excluded, it is limited to the fees you paid us in the preceding three months, or NZ$100 if you paid nothing. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 where it applies; if you use the service for business purposes you agree that Act does not apply.
Governing law
These terms are governed by the laws of New Zealand and the courts of New Zealand have exclusive jurisdiction.
